Expertasia Travel - General Conditions

1. VALIDITY

Offers and the rates shall be effective from 1st November 2014 to 31st October 2015, unless otherwise specified.

2. CONFIDENTIALITY

This contract and all documents related thereto shall be treated as private and confidential and must not be disclosed to third parties for whatever reason or purpose.
All rates are net per person twin sharing and paid in Thai Baht (THB), unless otherwise specified.

3. INCLUDED IN THE PRICE

Items and services included for each tour program are listed in their own respective sections.

4. NOT INCLUDED IN THE PRICE

Visa fees other that mentioned.
Flight tickets other that mentioned.
Travel Insurances.
Drinks, tips, personal expenses and all services not clearly mentioned.
Items of personal nature such as laundry, telephone calls, excess baggage fees and meals (Unless if specified on individual tour itineraries).
Daily parking fees at hotel and any other items not specifically mentioned as included will be borne by the client directly.
Tips to porter, bellman, and hotel maids… (Unless if specified on individual tour itineraries)
Tips to the guides & drivers are not compulsory but just a way to show your appreciation to the good services provided. Recommended tipping for driver and guide is 150 THB (Thai Baht) net per person per day.

5. INVOICING & CURRENCY

All rates are net per person twin sharing and paid in Thai Baht (THB), unless otherwise specified.

Any credit terms are subject to the credit limit determined by Expertasia Travel. Expertasia Travel reserves the right to revoke such credit arrangement in the event of failure by the Company to make timely payments.

6. PAYMENT TERMS

6.1. Guarantee Policy / Deposit Requirement:

Expertasia Travel reserves the right of a guarantee deposit for every booking as a confirmation of the reservation requested by the Travel Intermediary. The deposit is to be paid to Expertasia Travel at least 60 days prior to the arrival of the guests. Otherwise, Expertasia Travel reserves the right to cancel all non-guaranteed bookings without prior notice. Once guaranteed, the money becomes subject to Expertasia Travel cancellation and no-show policies.

Expertasia Travel requires payment of the total (100%) Invoice amount as a confirmation of the booking requested by the Travel Intermediary. Expertasia Travel must receive 100% of all payment of the total invoice(s) amount(s) at least 31 business days prior to the arrival of the guests. Otherwise, Expertasia Travel reserves the right to cancel all non-guaranteed bookings without prior notice. Once guaranteed, the payment becomes subject to the Expertasia Travel’s cancellation and no-show policies.

6.2. Guaranteed reservation conditions:

A floating cash advance deposit can also be established to be paid in the minimum amount in accordance to the Guarantee Policy to secure the booking.
For series (group or individual tours), a deposit on the total amount (based on the booking) will be paid within 60 days prior to guest arrival. The amount of this deposit will be fixed in a specific contract between Expertasia Travel and the Travel Intermediary.

6.3. Particular clause by country:

If Particular payment terms are apply to some countries (ex: Myanmar), they will be individually mentioned in the specific offer made by Expertasia Travel to the Travel Intermediary.

7. PAYMENT PROCEDURES

Payment shall be made using Telegraphic Transfer
The Travel Intermediary shall may payments in Thai Baht unless otherwise requested.
Payment in foreign currency could be done only when specified in foreign currency on invoice/file of the Travel Organizer or after written agreement of the Travel Organizer. In this case, the Travel Organizer reserves also the right to change the conversion rate due to market rate fluctuation and should the Thai government change its foreign exchange system.

When making payment, on the bank remittance advice, please mention:
− Our file reference and/or invoice number,
− Your file reference (and/or name of your clients).

After making payment, to facilitate the clearance of payment from our local bank please send us a copy of the remittance advice obtained from your bank by e-mail at vanatsanun@expertasia-travel.com

9. PAYMENT DISPUTE

In the event of any dispute over invoices, the total sum claimed by the Expertasia Travel shall be paid first. After reconciliation between both parties, the Expertasia Travel will then issue a Credit Note or a Supplementary Invoice to effect the adjustments. In case Expertasia Travel is not getting the agreed amount from the Travel Intermediary, his clients lose the right and cannot use the travel services.

10. DELAY IN PAYMENT

The Travel Intermediary is obliged to pay a fine of 0, 2% of the total agreed amount per day for the delay in payment.

11. PAYMENT AMOUNT

Payment amount received must be as per invoice amount due to Expertasia Travel.
Expertasia Travel reserves the right to charge any balance of short payment due to incurred bank charges. Bank charges are to be borne by the payer.

12. CHANGE OF PRICES

All prices quoted are correct at the time of printing. In the event a service provider increases its prices to Expertasia Travel during the course of this contract, Expertasia Travel reserves the right to increase the prices under this contract.

13. HOTEL RATES

In view that our hotel suppliers practice dynamic pricing with frequent rate changes, this tariff only serve as a guideline. Expertasia Travel reserve the right to amend the hotel rates under this tariff or our hotel selling rates will be adjusted simultaneously with hotel amendment rates without prior notice.

14. VALUE ADDED TAX (VAT)

Sales tax, or VAT (Value Added Tax), is 7% on all purchases. The Thai Government has announced that they will raise the VAT to 8% for both goods and services.
However, the new VAT rate has not yet been decided. Therefore, rates quoted in this contract shall be subjected to the new VAT when it comes into force.

15. BOOKING REQUEST

Booking requests shall be made by sending a complete Booking Form (in English) with full details of the Travel Intermediary to the Travel Organizer by E-mail to: booking@expertasia-travel.com
With booking request accepted by Expertasia Travel within 15 days prior to the scheduled arrival, an additional late booking fee at 1,000 THB (Thai Baht) net per booking will apply.
All reservations are subject to availability. Expertasia Travel is obliged to send a written confirmation or refusal (according) to the Travel Intermediary within 48 hours of a previewed booking.

16. CANCELLATION POLICY

No charge for any cancellation that occurs 31 business days prior arrival date except for flights, cruises, or exceptional services which will be advised separately (Unless different Cancelation policy from the suppliers applies, as per example for peak season and Public Holidays)
For cancellation requested less than 31 days before arrival, the cancellation fee will be:

Days before arrival: Cancellation charges
Less than 31 business days:    25% of the total Invoice amount
Less than 20 business days:    50% of the total Invoice amount
Less than 10 business days:    75% of the total Invoice amount
Less than 05 business days:    100% of the total Invoice amount
No show:    100% of the total Invoice amount

Particular Cancellation Policy by country:

If Particular Cancellation Policy are apply to some countries (ex: Myanmar), they will be individually mentioned in the specific offer made by Expertasia Travel to the Travel Intermediary.

17. REMARKS

Offer subject to availability.
Program is subject to change without prior notice due to airlines unexpected changes of schedule or flight cancellations.
Expertasia Travel reserves the right to make adjustments to sightseeing or domestic flights in case of unforeseen circumstances.
Special requests such as connecting rooms, double-bedded rooms, smoking rooms, dietary requirement, coach or aircraft seating plan, rooms on higher/lower floor and immediate
check-in should be requested at time of booking, and such requests are subject to availability.
No refund can be made for any unused services including accommodations, transfers, entrance fees and meals.
Luggage and personal effects are at the owner’s risk throughout the tour; Expertasia Travel holds no liability for lost or damaged baggage.
We strongly suggest the passengers purchase travel insurance at their home countries before
traveling.

18. CHILD POLICY

Child is defined as an individual above 2 years and below 12 years.
Unless otherwise stated in the tariff, a child under the age of 12 years old occupying the same room as his/her parents and using existing bedding is usually accommodated free of
charge, except where a child rate is stated.
Child rate is 50% of adult rates (on twin sharing basis) for private package tours inclusive of meals and accommodation.
The child rate is based on the child sharing a twin room with two (2) adults.
